RAPID CITY, S.D. - A Rapid City man charged with manslaughter during a drug deal gone was back in court Monday.

Defense attorney's for 30-year-old Charles Birdshead are demanding evidence from state prosecutors.

Birdshead is charged with felony manslaughter for the shooting death of 33 year old Eustacio Maruffo at the South Dakota Rose Inn on January 7th.

A judge on Monday granted a defense request to have key evidence tested independently for blood and DNA analysis. The evidence comes from a 15-year-old female, with whom Birdshead is alleged to have had a sexual relationship, according to state prosecutors.The defense was also granted access to addresses, names and locations which had been redacted out of police reports.

State prosecutors called the request a 'fishing expedition' saying they believe witnesses may be threatened if their contact information was released.
